California DUI Penalty Enhancement: Multiple DUI Offenses
A DUI Penalty Enhancement under California Law will apply to a second or subsequent offense for Driving Under the Influence ( DUI ) of Alcohol and / or Drugs where a prior DUI conviction exists within a ten year period.
California Vehicle Code §23580:
Repeat Offenders of Multiple DUI convictions. One or more prior DUI related offenses requires mandatory imprisonment.California Punishment for Multiple DUIs
A Second or Subsequent DUI Offense Involving Alcohol and / or Drugs is punishable as a Multiple DUIs enhancement, or aggravating factor.
1. The court shall impose at least 48 hours of continuous imprisonment or alternatively order no less than 10 days of community service to any driver convicted of a second or subsequent DUI related offense.
2. Imprisonment will impose incarceration and confinement in a detention center, jail, or inpatient rehabilitation facility
